“The importance of the judgment is the increased protection given to holders of well-known trademarks, reflected in the fact that the compensation ordered against the infringers is the highest awarded to date by the Spanish Community Trademark Court. The judgment takes into account the actions of the holder to ensure its trademark is widely known and enjoys high prestige: advertising investment, widespread use, appearance in the media, merchandising, creation of new concepts, etc.

Well-known trademarks thus involve large investments and also the need for comprehensive controls to avoid dilution of exclusive image rights”.
